*Relevance to the ACA:
The ACA requires the establishment of health benefits Exchanges. It delegates primary responsibility to the states, but requires the federal government to step in for states that opt out. Provisions relevant to establishing an Exchange include:
§1311 - Establishes the Exchanges and creates grants for states to plan and launch them.
Also creates the option for regional Exchanges and sub-state Exchanges.
§1321 - Gives the Secretary of HHS the power to establish and operate an Exchange in a state that defers or whose Exchange does not meet statutory requirements.

North Dakota
During a special legislative session in November 2011, HB 1474 was introduced. The bill would have created a new division in the Office of Management and Budget and full-time positions in OMB, ITD and DHS to build a state-run Exchange. The bill failed the House 64-30 after a lengthy debate.

Andrea Fonkert of the North Dakota Insurance Department shared HB 1126, which has been enacted into law, and authorizes the insurance department to work with the state human services department to plan the Exchange.
