    *Relevance to the ACA:

    The ACA imposes new requirements on states and facilities for reporting information about the leadership and performance of nursing facilities. Some of the provisions relevant to nursing home information transparency include:

    §6101 – Requires nursing facilitates to report information about ownership identity and controlling interests, members of their governing bodies, and managing employees to states and DHHS.

    §6103 – Specifies the information states must submit to the Nursing Home Compare Medicare website on the characteristics and performance of nursing facilities.

    § 6103 – Requires states to maintain a consumer-oriented website that provides information on all nursing facilities, including inspection reports, complaint investigation reports, and survey correction plans.

    § 6111 – Establishes new procedures for state collection of civil monetary penalties from nursing facilities, and specifies potential ways states can use the penalties to benefit residents.

    § 6113 – Describes the resident transfer and relocation plans that facilities must submit to the state prior to a facility closure, and requires states to assure that all residents are successfully relocated.
